1. Acceptance of these terms
These Terms of Service ("Terms") form a binding agreement between you and [LEGAL ENTITY NAME] ("Pinned," "we," "us," or "our") governing your use of the Pinned AI: Peptide Tracker mobile application and related services (the "App"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
2. Eligibility
You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are 18 or older and able to enter into a binding agreement.
3. The service
The App is a tool that lets you record and organize personal information, including dose logs, injection sites, schedules, reminders, body weight, and nutrition data, and view summaries and insights generated from the data you enter. Features may change, be added, or be removed over time.
4. Medical disclaimer
The App does not provide medical advice. Pinned AI is intended for personal informational and organizational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment, and it is not a medical device.
- The App does not recommend, prescribe, or endorse any substance, dosage, schedule, or course of treatment.
- Reminders, summaries, suggested injection-site rotations, and insights are conveniences based on data you enter; they are not medical recommendations and may be incomplete or inaccurate.
- Nutritional estimates from meal scanning are approximate and should not be relied upon for medical or clinical decisions.
- Always seek the advice of a qualified, licensed healthcare provider with any questions regarding a medical condition, medication, or treatment. Never disregard professional medical advice or delay seeking it because of something in the App.
- You are solely responsible for any decisions you make regarding any substance or protocol. Laws regarding peptides and other substances vary by jurisdiction; you are responsible for complying with all applicable laws.
If you think you may have a medical emergency, call your doctor or your local emergency number immediately. The App is not designed for use in emergencies.
5. Your responsibilities
You agree to use the App lawfully and only for its intended personal-tracking purpose. You agree not to misuse the App, attempt to reverse engineer or disrupt it, or use it in any way that violates applicable law or these Terms. You are responsible for the accuracy of the information you enter.
6. Subscriptions and billing
The App may offer auto-renewing subscriptions that unlock premium features. Subscriptions are sold and processed by Apple through the App Store, and our paywall is powered by Superwall.
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period.
- You can manage or cancel subscriptions in your Apple ID account settings. Deleting the App does not cancel a subscription.
- Except where required by law, payments are non-refundable; refund requests are handled by Apple under its policies.
7. Intellectual property
The App, including its design, text, graphics, and software, is owned by Pinned or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-transferable, non-exclusive license to use the App for your own personal use, subject to these Terms. The data you enter remains yours.
8. Disclaimer of warranties
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that any insight or estimate it produces is accurate or reliable.
9. Limitation of liability
To the maximum extent permitted by law, Pinned and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, or for any harm arising from your use of (or inability to use) the App or from any decision you make in reliance on it. To the maximum extent permitted by law, our total liability for any claim relating to the App will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $50.
10. Indemnification
You agree to indemnify and hold Pinned harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the App, your violation of these Terms, or your violation of any law or the rights of a third party.
11. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of [STATE / COUNTRY], without regard to its conflict-of-laws rules. You agree that any dispute will be resolved in the courts located in [JURISDICTION], except where prohibited by applicable law.
